The Role:

Her Majesty’s Court and Tribunals Service (HMCTS) is an agency of the Ministry of Justice and provides the supporting administration for the judiciary in England and Wales across four jurisdictions: Crime, Civil, Family and Tribunals. It delivers services to the public directly in court and tribunal buildings, remotely via business centres and some limited services via the internet.

HMCTS is undergoing a period of unprecedented change, which is being managed through a range of change programmes with a combined budget in excess of £1billion.

To help us on this journey, we’re looking for an exceptional candidate to join us in the role of Commercial Business Partner.

You will be working at the heart of the reform agenda, delivering a quality sourcing service and getting the best value for money for HMCTS. Successful delivery will be vital to the success of the reform programme, therefore excellent contract and supplier management will also be needed once a contract is in place.

This role will deliver the full end to end commercial and contract management service, with a focus on helping HMCTS define their requirements but can also require the successful candidate to support the most appropriate procurement process, assist the contract management process to ensure the project sees the expected benefits.

You will be required to work closely with a wide variety of, often very senior, stakeholders, across different functions to make sure our contracts deliver what they’re supposed to and are properly governed. 

Key responsibilities include: 

  • Helping stakeholders shape their requirements and providing commercial advice from an early stage;
  • Ownership of strategy at contract level, driving commercial opportunities to deliver value for money and/or savings;
  • Plan, deliver and track commercial activity ensuring that it is delivered to time;
  • Resolving contractual and commercial issues, escalating as required;
  • Coordinate with internal stakeholders to gather savings and efficiency and contract management reports;
  • Stakeholder engagement and strong relationship building to build requirements, and then to own, develop, implement and manage the procurement and contract management strategies (stakeholders include: customers, suppliers, legal and finance);
  • Ensuring that all stakeholders understand and adhere to contractual obligations and impact of financial aspects of contracts and commercial processes;
  • Supplier contract management to ensure robust management of commercial delivery against contract (including payment mechanisms and KPI delivery) whilst driving innovation to create value for money;
  • Involvement in business improvement workstreams;
  • Associated adherence to respective policy and governance controls; and
  • Development and management of procurement processes where required.

Essential Criteria:

  • A proven track-record delivering end-to-end contracting life cycle including shaping business requirements, procurement, contract and supplier management;
  • Strong business acumen and ability to show logical, evidence-based decision making;
  • Excellent written and oral communication skills;
  • Awareness of public sector procurement legislation;
  • Experience managing relationships with other commercial teams, contractors and stakeholders. Must be able to work across teams and bring people together to achieve a common objective;
  • Confident self-starter who is willing to assess the status quo, grasp the challenges, demonstrate appropriate influencing and leadership skills to achieve the best outcome;
  • You must be able to work on several projects simultaneously and use your judgement to decide which projects should be prioritised;
  • Ability to drive commercial outcomes and demonstrate delivering value for money against commercial strategies; and
  • Be computer literate with the ability to assimilate new business systems.

The post holder must have, or be working towards, at least one of the following (equivalents may be considered).

  • Masters Business Administration (MBA)
  • Membership of the International Association for Commercial and Contract Management (IACCM)
  • Membership of the Chartered Institute of Procurement and Supply (CIPS)

Working Arrangements & Further Information

Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. Grading Structure Review
