Introduction

The varied work of the Chancery Division includes the handling of disputes relating to high value commercial business, property or land, disputes relating to trusts and pensions as well as probate disputes and declarations of presumed death. The Division also has an appellate jurisdiction over decisions from Masters, Insolvency and Companies Court judges, the lower courts and some statutory bodies. 

 Job Description

 This is an exciting opportunity for a caseworker to work with the Issue team, the Listing team, the Chancery lawyer and members of the judiciary in order to provide pro-active case management in relation to civil claims and applications for permission to appeal to ensure that cases are managed both effectively and expeditiously. This role requires a high level of initiative and the ability to communicate with customers, stakeholders at a senior level and senior members of the judiciary.  

 Key responsibilities and duties:

  • Case management to manage cases using CE file so that they are progressed consistently, efficiently and in accordance with the Civil Procedure Rules’ overriding objective or other relevant rules, with a view to minimising delay and reducing any backlog
  • Prioritising applications to identify and advise on the timescales applicable to immediate / urgent applications and to prioritise the applications’ caseload effectively in accordance with changing business demands, adapting as necessary to ensure that urgent and or high-profile matters are progressed appropriately
  • To ensure that applications are alerted to the same judge in a case who has been made any earlier orders or who is dealing with the case. In an exceptional case, may have to refer application to a different judge but will need to explain why done so
  • Lawyer Support to work with the Chancery Lawyer in developing an innovative and dynamic quality service and to assist the Chancery Lawyer to effectively manage permission to appeal applications
  • Case notes to prepare accurate and succinct referral sheets to accompany applications to be alerted to the judiciary, using templates agreed with the Chancery Lawyer and the judiciary
  • Collaborative working with staff to ensure that applications are appropriately managed, providing information and advice to Issue and Listing teams when requested and where process deviations have occurred
  • Implementation of a system of recording applications received in the Chancery Division in order to identify patterns and for dissemination to operational managers and stakeholders where appropriate

 Accountability

The post holder will report to the Senior Listing Officer.  The post holder is required to work in a flexible way and to undertake any other duties reasonably requested by line management which are commensurate with the grade and level of responsibility of this post

Essential Skills & Experience 

  • Excellent written communication skills to assist with drafting referral sheets and notes in a variety of proceedings
  • Case management experience and ability to prioritise effectively and to work at pace with a high degree of accuracy
  • Good knowledge of the work of the Chancery Division or the ability to acquire that knowledge quickly
  • Have a working knowledge of the Civil Procedure Rules and be able to apply that knowledge appropriately
  • Ability to support the Chancery Listing team and the Issues and Enquiries team with more complex queries and to provide training or advice as necessary on new areas of development
  • Confident use of IT systems to ensure effective case management.

Working Hours / Pattern:

These operational roles are customer facing, requiring successful applicants to be office based to provide HMCTS services to the public.  Standard full time working hours are 37 hours per week. HMCTS welcomes part-time, flexible and job-sharing working patterns, where they meet the demands of the role and are agreed prior to appointment. All applications for part-time, flexible and job-sharing working patterns will be treated fairly and, on a case-by-case basis in accordance with the MoJ’s Flexible Working policy.

Excess Fares and Relocation Allowances

This job is not eligible for relocation allowances, but excess fares may be considered in accordance with MoJ’s excess fares allowance policy.

Working Arrangements & Further Information

The MoJ offers Hybrid Working arrangements where business need allows. This is an informal, non-contractual form of flexible working that blends working from your base location, different MoJ sites and / or from home (please be aware that this role can only be worked in the UK and not overseas). All employees will be expected to spend a minimum of 60% of their working time in an office, subject to local estate capacity.

Some roles will not be suitable for Hybrid Working. Similarly, Hybrid Working will not suit everyone’s circumstances. Arrangements will be discussed and agreed with the successful candidate(s) and subject to regular review.

For nationally advertised roles, the successful candidate(s) will be appointed to a MoJ office location, which may include their nearest Justice Collaboration Centre or Justice Satellite Office. This will be discussed and agreed on the completion of pre-employment checks. 

Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. Details will be available if an offer is made.

MoJ candidates who are on a specialist grade, will be able to retain their grade on lateral transfer.

Counter-Terrorism Check (CTC)
