Overview of the job    

The Senior Caseworker will report to the Deputy Head of Safer Custody Casework and is placed within the Prison Safety & Drug Strategy Group in Transforming Delivery in Prisons.  The post is based in HQ and located at Southern House in Croydon.

HMPPS is committed to making prisons safer places for people to live and work in. Learning from deaths in custody and serious incidents of self-harm and assaults and reducing the costs of litigation are key activities.

The main functions of the Safer Custody Casework team are to deal with the casework, litigation and correspondence relating to deaths and near deaths (incidents of serious self-harm and assaults) and food refusal cases in custody.

The team also contribute to the learning from deaths and near deaths in custody.

Summary    

The job holder will be responsible for a caseload of medium/high profile death in custody cases in allocated regions. The job holder will assist Government Legal Department (GLD) and prisons in preparing for the inquests and handle the civil claims arising from deaths in custody.

The job holder will liaise with prisons, independent investigators, GLD and MoJ lawyers on a regular basis.

This is a highly sensitive area of work, which attracts considerable Ministerial, media, public and pressure group attention.

Responsibilities, Activities and Duties    

The job holder will be required to carry out the following responsibilities, activities and duties:

•    Manage a caseload of medium/high profile death in custody cases within allocated regions (around 70 prisons ) and have oversight of the natural causes deaths caseload of the EO in their allocated regions (in total around 125 cases)
•    Provide instructions to GLD, comment on Counsels’ submissions to the Coroner, liaising with MoJLD and prisons where necessary and consider lengthy and complex legal documents, witness statements and legal arguments and amend as necessary. Seeking advice from Deputy Head of Casework and/or Head of Casework where necessary.
•    Identify conflict of interest issues and seek advice from GLD/Counsel/MOJLD about the appropriateness of GLD/Counsel representing the member of staff and then make a recommendation to head/deputy head of team about whether representation and funding should be provided.
•    Consider the disclosure of security information including SIRs for inquests taking into account of DPA, FOI and any other relevant obligations and determine what can be released.
•    Consider Particulars of Claims and provide instructions to GLD/Counsel on handling tactics, liability, quantum and appropriateness of deploying arguments using relevant caselaw ensuring that the course of action proposed balances the need for reduced costs while not exposing HMPPS to admissions of failure where there have been none.
•    Seek the relevant authority to settle civil claims on behalf of the Secretary of State, providing the legal advice and sufficient detail about the case to enable an informed decision to be made.
•    Consider costs bills up to the value of £200K, reviewing GLD/Counsel’s advice and agreeing Points of Dispute submissions before seeking the relevant authority to settle the costs bill.
•    Prepare draft responses to Coroners’ Reg 28 letters, Freedom of Information (FoI) requests, Ministerial Cases, and advice to HMPPS Directors. Contribute to Parliamentary briefings and PQs as required.
•    Have oversight of the EO’s caseload for the job holder’s allocated regions; with responsibility for signing off their draft responses to treat official letters and responses to GLD and Coroners when required.
•    Log details of serious assaults, serious self-harms, cell fires, and food refusals, do follow up enquiries and raise any issues with the Group Safety Team and senior managers.
•    Follow up awaiting further information (AFI) deaths and make proposals for the reclassification. Provide external stakeholders with a quarterly update.
•    Attend court hearings (including coroners’ inquests) and case conferences,
liaising with lawyers and HMPPS witnesses as required.
•    Contribute to Casework Team meetings, help inform death in custody casework practices. Chair casework meetings in the absence of the Deputy Head of casework and support the Deputy Head and Head of Safer Custody Casework as required.

Working Arrangements & Further Information

The MoJ offers Hybrid Working arrangements where business need allows. This is an informal, non-contractual form of flexible working that blends working from your base location, different MoJ sites and / or from home (please be aware that this role can only be worked in the UK and not overseas). Some roles will not be suitable for Hybrid Working. Similarly, Hybrid Working will not suit everyone’s circumstances. Arrangements will be discussed and agreed with the successful candidate(s) and subject to regular review.

For nationally advertised roles, the successful candidate(s) will be appointed to a MoJ office location, which may include their nearest Justice Collaboration Centre or Justice Satellite Office. This will be discussed and agreed on the completion of pre-employment checks.

Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. Details will be available if an offer is made.

Standard working hours for this post are 37 hours per week excluding breaks which are unpaid.
