Background

The Offices of the Official Solicitor and Public Trustee (OSPT)

The office is an Arms’ Length Body of the Ministry of Justice and combines the duties and responsibilities of 2 separate independent statutory office holders - the Official Solicitor to the Senior Courts and the Public Trustee. There are around 135 staff who support the work of the Official Solicitor and Public Trustee, including lawyers, lay case managers and administrators; the office is based in Central London. We promote access to justice for the most vulnerable members of our society who might otherwise be unable to use the services offered by the justice system due to their lack of mental capacity or because of their young age. We are committed to providing the best level of service we can for our clients. 
We have Team Leader vacancies on our International (x1) and Litigation Teams (x2). 

International Team: The Lord Chancellor has delegated his operational function under several international agreements to the ICACU (International Child Abduction and Contact Unit) which is based in OSPT.  The unit acts as operational Central Authority for England and Wales (in the case of one agreement, for England only). The unit is responsible for discharging the Lord Chancellor's obligations under these agreements. 

The Team deals with all applications and requests in respect of International Child Abduction matters and Requests for Co-operation from local authorities here and from Central Authorities in foreign jurisdictions in relation to cross border child abduction and contact and in child protection cases including care proceedings. 


Litigation Team:  The Official Solicitor has responsibility for three Litigation teams; Family Litigation, Healthcare and Welfare and Civil Litigation. In the main, the Official Solicitor acts as a last resort litigation friend, and in some cases solicitor, for children (other than those who are the subject of child welfare proceedings) and for adults who lack mental capacity. 

These posts are likely to be housed in the Civil Litigation Team. 

The Civil Litigation team deals with a wide range of Civil Litigation proceedings in the High Court and the County Court, including, but not limited to Possession cases, Clinical Negligence cases, Personal Injury cases, Local Authority Damages cases, Human Rights Act cases and Judicial Review where a party has been assessed to lack litigation capacity. The variety of work makes it very interesting and rewarding. The Official Solicitor's role is usually that of a litigation friend and she instructs solicitors and Counsel in cases as is required. 

The Team Leader Role

The successful candidate will work closely with a Senior Operational Manager, OSPT Lawyers and MoJ Policy colleagues as necessary. The Team Leader will have line management responsibility for senior case managers and act in a supervisory and advisory capacity where there are complex casework issues. You will also lead on relevant policy and operational issues. The role requires close engagement with a wide range of stakeholders, including local authorities, other government officials, the judiciary and foreign agencies in the case of the International role. This area of work is fast paced and varied. 
There is the possibility that some travel may be required for the role on the International Team.

This role offers unique development opportunities and includes leadership responsibilities as the successful candidate will have overall responsibility for the team’s active caseload and the delivery of the service.  Strong resource management and technical skills are therefore important in this role, as is the ability to encourage and support good morale and staff wellbeing.

The role encompasses a number of motivating and challenging priorities including:

•    Overall responsibility for either the International team or a Litigation Team.
•    Leadership of HEO’s, including support through training and development.
•    Play an active role in stakeholder engagement activities.
•    Work closely with the legal team and Senior Manager to ensure priorities are agreed and delivered and the operational needs of the team are met.
•    Oversee the allocation of work
•    Champion change within the team and proactively look to realise efficiencies in terms of ways of working. 
•    Collate, maintain and present accurate management information.

Ad hoc corporate initiatives alongside Full Leadership Team colleagues.

It is essential that you have experience of using Microsoft computer packages, i.e. Word, Excel, Outlook, PowerPoint and Teams

The OSPT is based at 102 Petty France, London, but the successful candidate does not have to be London-based. We currently operate a hybrid working arrangement. This means that 40% of the working week is office based. The successful candidate will be appointed to a MoJ office location, which may include their nearest Justice Collaboration Centre or Justice Satellite Office.

Working Arrangements & Further Information

The MoJ offers Hybrid Working arrangements where business need allows. This is an informal, non-contractual form of flexible working that blends working from your base location, different MoJ sites and / or from home (please be aware that this role can only be worked in the UK and not overseas). Some roles will not be suitable for Hybrid Working. Similarly, Hybrid Working will not suit everyone’s circumstances. Arrangements will be discussed and agreed with the successful candidate(s) and subject to regular review.   

For nationally advertised roles, the successful candidate(s) will be appointed to a MoJ office location, which may include their nearest Justice Collaboration Centre or Justice Satellite Office. This will be discussed and agreed on the completion of pre-employment checks. 

Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. Annual Leave

Annual leave is 25 days on appointment and will increase to 30 days after five years’ service.
