Overview

HMCTS is embarking on a period of significant change which will see the organisation transform over the next 5 years. Strong leadership is a critical element in this being successful. The HMCTS Governance and Assurance function will have a pivotal role in supporting senior stakeholders and their teams through the change, with the right strategy to build the necessary organisational capability and to realise the benefits needed.

Main purpose of the role:

As a Counter-Fraud and Investigations Officer in HMCTS your role is to protect value, drive value and add value.

Your role will be to be responsible for the conduct of, management of, and reporting on fraud and other investigations as required within HMCTS including more complex, high-profile and high-value investigation. You will support the Counter Fraud & Investigations Manager on leading work within reform to secure fraud and criminality threats. Contribute to developing and implementing an effective counter-fraud strategy for the organisation covering fraud policies and processes for fraud prevention and detection. You will maintain the fraud control and reporting framework for the Agency and work with colleagues to ensure that it remains appropriate to manage referrals of potential fraud, irregularity and corruption from within HMCTS and from external sources.

You will provide effective, active and dynamic leadership, communicating objectives, plans and priorities with clarity, conviction and enthusiasm. You will become involved in national initiatives that continue to develop the governance and assurance function with regard to delivering services and improving management information.

Key Responsibilities

  • You will carry out investigations on referrals made to the Counter Fraud & Investigations Manager, focusing on business/financial recovery and acting in the interests of the agency and in accordance with the relevant laws and procedural rules
  • You will provide assistance to the Financial Assurance team in identifying and mitigating fraud risks across key financial process lines and systems
  • You will conduct investigations within HMCTS ethically including on the more complex, high-profile and high-value investigations
  • You will engage closely with relevant areas of the business on suspected criminal matters, conducting interviews of witnesses including staff, suppliers and any other parties, gathering evidence on suspected criminal incidents. secure, preserve and record exhibits for use in criminal or civil cases, and work with police forces, the National Fraud Authority, the National Crime Agency (NCA) and other external bodies in pursuing criminal investigations
  • You will draft reports for review by management and HR on suspected fraud incidents and recommend courses of action, and where required you will provide expert testimony in court cases as directed and required by the Counter Fraud & Investigations Manager
  • You will assist in meeting any necessary external reporting obligations in relation fraud or suspected fraud incidents
  • You will provide the business with assessments on the potential impact of frauds to HMCTS’ financial assets and public reputation.
  • You will support the work within reform to secure fraud and criminality threats.
  • You will support the development and implementation of an effective counter-fraud strategy for the organisation covering fraud policies and processes for fraud prevention and detection
  • You will support the delivery of fraud awareness sessions with staff throughout the business as part of delivering the counter fraud strategy
  • You will ensure that all fraud investigations are conducted with a priority for business/financial recovery
  • You will provide visible, approachable leadership to team(s), maintaining a continuous dialogue with staff in respect of change, performance and celebrating successes
  • You will show personal commitment to innovation (CI), actively listen to staff ideas/concerns and act upon them

  • You will work in a flexible way and undertake any other duties reasonably requested by line management which are commensurate with the grade and level of responsibility of this post and deemed necessary by line management to fulfill the role and requirements of the team.

Essential Skills – This will be tested at interview

  • Working knowledge of PACE, RIPA, CPIA, Fraud Act 2006, Theft Act 1968.

The job holder must be able to fulfil all spoken aspects of the role with confidence in English or (when specified in Wales) Welsh.

Working Arrangements & Further Information

Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. Details will be available if an offer is made.
